WATER: Vertical Migration

Did you know the largest biological migration on Earth takes place – every night? It is called Diel Vertical Migration (DVM). This week, as the United Nations 76th General Assembly convened, leaders of over 100 nations attended in person. Speakers included presidents and policy-makers who addressed 12 commitments. But this year, there was additional representation: Nature. The message is one of growing awareness of the Rights of Nature. From the 1962 General Assembly Resolution 1803 (XVII) on “Permanent Sovereignty over Natural Resources” and the 1982 “World Charter for Nature” to the recognition of personhood rights of the Whanganui River of New Zealand in 2017, the rights of nature will grow in importance during climate change.

DVM acts as a biological pump, renewing oceans and lakes, in ways essential to the marine environment. Organisms move up to the top at night, and return to the bottom by day. Crustaceans commute; so do trout. In the process, conversion of C02, and inorganic nutrients, transfer zones. This cleansing and renewing system is one of the treasures of the marine cycle. By bringing attention to vertical migration, the United Nations may set the stage for COP 26 in Glasgow, November 2021, where environmental issues will be decided. Displayed on the night-cloaked facade of the United Nations iconic building, the film “Vertical Migration” brought awareness to the largest migration our world knows, and the importance of marine life in a sustainable, balanced future. CITIES: Liberty, Diplomacy, Art (and Fireworks!)

On Independence Day, France will give a gift of diplomacy to the United States, celebrating the shared value of liberty. France’s national motto “Liberté, Égalité, Fraternité” (Liberty, Equality, Fraternity), and the American holiday of independence, will join sentiments as a replica of the Statue of Liberty is presented by the Museum of Arts and Crafts in Paris for a ten-year visit to the land of her big sister. “Little Lady Liberty” (9.3 feet or 2.8 meters) joins the original Statue of Liberty (305 feet or 93 meters) that was a gift from France to the United States in 1886.

While Frédéric-Auguste Bartholdi designed the sculpture, the creator of the eponymous Eiffel Tower in Paris, Gustave Eiffel, crafted its internal structure, introducing an innovative design that relied not on weight as support but on a flexible structure with a central pylon supporting a web of asymmetrical girders. Since its arrival in 1885, the iconic monument has stood on Liberty Island in New York Harbor, welcoming those who came to its shores in search of freedom. The visiting French replica will be displayed on Ellis Island to bear witness to Independence celebrations, before moving to other locations, culminating in Washington, D.C. for its unveiling on July 14, in honor of Bastille Day. The visitor will remain for 10 years. As the world seeks to foster shared values, should countries exchange public art for display, especially in national capitals, as an outreach of diplomacy? CITIES: Iconic Pride

Cities have an opportunity to inspire and unite urban denizens in shared values. As Toynbee demonstrated in Cities of Destiny, the metropolis can create a unique cultural climate. Many urban centers possess iconic monuments, like the Eiffel Tower in Paris, that may serve as cultural billboards. As the world gathered in Paris for COP21 in 2015, that landmark beamed the message: “1.5” –  indicating a shared goal of limiting global warming to that level. Other issues like social justice have illuminated city monuments: San Francisco’s City Hall has often been displayed in rainbow colors.

London, England, has many landmarks including the fabled London Bridge and the recent addition to the cityscape: the London Eye. This month, the “Eye,” formally termed the Millennium Wheel when it opened in 2000, displayed rainbow colors to honor Pride, commemorating the 1969 Stonewall turning point for LGBT+ rights.

In June of 2015 when the United States Supreme Court ruled (Obergefell v. Hodges) two people of same sex have the right to marry, the White House celebrated by illuminating the iconic Washington D.C. building in the colors of the rainbow. As we strive to build an equal and sustainable future – environmentally and socially – how can cities Troop the Color?

SPACE: What goes up, must come down. But how?

It was a long march and a splash entry. On 8 May, the Long March B5 fell from space into the Indian Ocean, thankfully missing the nearby 1, 192 islands of the Maldives. Long March 5B launched on 29 April 2021, conveying into orbit the hefty main module of the new space station that China is building, to open in 2022. Some questioned the decision not to fire the Long March 5B rocket engine after releasing its payload, therefore sending it into “uncontrolled reentry.”

Even if the odds were good, since 70% Earth happens to be water, dumping space debris in the ocean whether in controlled or uncontrolled reentry, may not the best practice. Just ask the marine life at 72.47 degrees East and 2.65 degrees North.

Controlled reentry aims at a watery grave. Coordinates 48 degrees 52.6 minutes south latitude and 123 degrees 23.6 minutes west longitude mark Point Nemo, or the Oceanic Pole of Inaccessibility. It’s 1,450 nautical miles from anywhere, which is why it is the chosen splash-down spot for space detritus. Between 1971 and 2016, space agencies worldwide crashed 260 spacecraft into Point Nemo: there’s part of the MIR space station, a SpaceX rocket, and over 100 resupply vehicles. Over time we may regret that ditching strategy, no matter how much we believe Point Nemo or the Oceanic Pole of Inaccessibility poses no problems. As water rights develop, the International Seabed Authority (ISA) may rule on Point Nemo.

But most space debris never gets to Point Nemo. There are an estimated 9,000 tones of material circling Earth. Many pieces like old satellites drop out of orbit and burn up before they hit the surface (that’s what happened to Sputnik, the first object in space in October 1957). But even such burning is cause for concern. Little has been done to assess effects on the upper atmosphere, especially consequences of alumina particles that remain trapped and can deplete the ozone layer. The protective layer that keeps Earth from ultraviolet radiation was the subject of the 1987 Montreal Protocol and 2016 Kigali Amendment.

Space business is increasing faster than we can keep up in laws and treaties. For example, early laws and conventions spoke only of governments, on the assumption that space was just too expensive for private enterprise. Today, companies like SpaceX are rewriting that text. Space law’s founding documents include the 1967 Outer Space Treaty and the 1972 Space Liability Convention. The first regulates what people can do in space; the second considers how to assign responsibility for activities or objects that cause damage. With satellite constellations like SpaceX and OneWeb launching rapidly, the sky is suffering from traffic, some of it from dead satellites taking of space while waiting to drop, burn, or splash. And we’re putting more up there. As of August 2020, there were 2,787 satellites in orbit (1,364 of those are communication satellites used by business and government). In addition, there are 3,000 dead satellites (and 34,000 pieces of space junk bigger than 10 centimeters and who knows how many particles) still up there, and causing not only traffic but danger.

We’re only getting started. Since COMSAT began, we’ve sent more satellites, and spacecraft, each year. Estimates now predict 9,000 units by 2025. Some of those will burn, some will splash, and eventually some of them will be retrieved. It’s a new industry. Watch for more laws about what goes up and how it comes down, along with innovations in space sanitation.

WATER: World Water Day 2021

World Water Day, begun in 1993, calls us to honor and preserve the world’s freshwater supply. Water, in the form of drinking water and safe sanitation, is the #6 Sustainable Development Goal of the United Nations.  Environmental historians observe that human history can be traced by innovations in water systems. Aqueducts built by the Romans brought fresh spring water to a growing city when the Tiber river became threatened. In England, the New River was one of the world’s first built watercourses, bringing potable water to the burgeoning city of London. The Colorado River Compact defined the rights and use of water for the American states of the Upper Basin (Wyoming, Colorado, Utah, New Mexico) and Lower Basin (California, Arizona, Nevada); sovereign peoples of the Navajo, Havasupai, Walapai, and several others; and México.  Rights of the Whanganui River of New Zealand established legal personhood in 2017, confirming a growing awareness of the rights of nature. Today’s World Water Day 2021 is dedicated to our personal use of water. While 71% of the world has access to safe drinking water, only 45% have use of safe sanitation. “The future we want, the United Nations we need: reaffirming our collective commitment to multilateralism,” states the declaration on the commemoration of the seventy-fifth anniversary of the United Nations (UN). Founded after the tragedy of World War II, the UN has worked to promote and protect human rights and fundamental freedom for all, in the context of sovereign equality of States and the right of self-determination for all. WATER: Rebuilding Oceans

Bridges can be rebuilt, but what about the water they span? There may be good news: oceans could return to vitality if we rebuild supportive habitats and conditions, according to a new study citing Sustainable Development Goal 14 of the United Nations. To save oceans, we will need to rebuild marine life support systems. Nature article authors include Carlos Duarte of King Abdullah University, Gregory Britten of MIT, and Robinson Fulweiler of Boston University, as well as worldwide team. Here are the key components:

Rebuilding oceans by restoring or preserving:

coral reefs

deep ocean environment and seabed

fisheries

kelp

mangroves

megafauna

oyster reefs

salt marshes

sea grasses

and – stopping and removing plastic pollution.

Finances will play a part: it will cost $10-20 billion per year to rebuild our marine environment by 2050. But there is a return on investment: for every $1.00 spent, there will be a return of $10.

An area of concern that receives less attention than merited is the International Seabed. While waters up to 200 nautical miles (a nautical mile is 1.1508 statute (or land-based) miles) are the territory of  individual coastal nations, the waters and seabed beyond belong to everyone, even land-locked nations. Present explorations measuring valuable ore deposits like cobalt, copper, and manganese may soon lead to mining licensing by the International Seabed Authority. Recently, some rivers like New Zealand’s Whanganui River have been granted legal personhood rights: will similar rulings affect and protect oceans?

Oceans are transit ways of civilization; ports like Boston, Hamburg, Jakarta, Lagos, New York, Rotterdam, Singapore, Yangon, became centers of exchange and urban life. Coastal cities may lead the way in rebuilding urban architecture for sea-rise, and also take special interest in rebuilding the sea itself.

Voice of the Future 2019: Nature

Should trees have standing? What about rivers? Nature’s rights are being recognized and legalized. Recently, Colombia established rights of the Atrator River and surrounding basin; India tried to grant personhood to the Ganges and Yamuna Rivers, citing as precedent New Zealand’s law recognizing rights of the Whanganui River. Voters in Toledo, Ohio, USA approved the Lake Erie Bill of Rights, giving legal status and assurance to exist, flourish, and evolve to the ecosystem of the Great Lakes. In both India and USA, the laws were immediately challenged and still to be resolved. On a larger scale, Bolivia passed the Law of the Rights of Mother Nature/Ley de Derechos de la Madre Tierra. Does Nature Have Rights?

So many trees burned in the Amazon forest that the fire could be seen from space. Brazilian satellite data from National Institute for Space Research (INPE) shows an 85% increase in fires, and double that in 2013. While the dry season from July to October sees fires caused by natural events such as lightning strike, other year-round causes may be clearing land for agriculture, grazing, or logging. Forests are damaged; wildlife decimated, and the air choking with smog; carbon emissions have spread as far as Bolivia. As a result, the Amazon basin, critical in regulating global warming because of its carbon-absorbing forests, may change the world environment. The G7 pledged millions in aid and planned to address vulnerable rainforests in Africa, calling these among the ‘lungs’ of the world. Brazil deployed army troops to combat the fire, quelling flames and perhaps some doubt.  But a question remains.

In 1972, Christopher Stone published the seminal work “Should Trees Have Standing?” regarding arboreal rights. Some say “Should Trees Have Standing?” began the environmental movement). There is emerging precedent: some rivers now have legal rights. The Whanganui River was granted rights of personhood in New Zealand; in India, the Yamuna River by the Taj Mahal joined the sacred Ganges in personhood. Bolivia established “LEY DE DERECHOS DE LA MADRE TIERRA: Law of Rights of Mother Earth.” Is this something new, or remembered? Granting personhood to Nature may be a return to the ancient myths, present in every culture, of water and nature spirits. Is it something we once knew?

Determining how to protect and sustain forests, restore burned or hacked ones, plant new ones, will surely be a critical part of the future. The Amazon forest, and the great forests of Africa, may look to many possible approaches. One path may be found in Benton MacKaye’s article “An Appalachian Trail: A Project in Regional Planning.” Brazil might consider neighbor Colombia where established rights for the Atrato River also granted rights for the surrounding Amazon forest; it is an intergenerational pact. Will Bolivia’s “Law of Rights of Mother Earth” lead the way ? Are these the voices of the future?

Cities: Singapore’s 3 Core Values

Singapore will mark its bicentennial this year, 2019, after celebrating its golden anniversary of independence in 2015. It was 200 years ago that two visitors rowed ashore to visit with a certain Sultan; Sir Thomas Stamford Raffles may not be enshrined by all, but still made a mark, including founding the Singapore Institution, one of the first global educational institutes. But many would say that Singapore’s core values were present long before either foundational event, and relate to openness as shaped by its extraordinary geography. Some historians cite Singapore’s three core values as:

Openness

Multiculturalism

Self-determination.

Not everyone would agree: for example, rights regarding sexual and gender orientation are still under trial, with relation and adoption key. Other concerns: water quality and deforestation threaten inclusion of the environment in future plans, but green building has been mandatory since 2008, influenced by Cheong Koon Hean, architect and urban planner.

Singapore’s recognition of many languages (Cantonese, English, Hokkien, Malay, Mandarin, Tamil) and faiths (observed in houses of worship such as the Buddhist Kuan Yin Temple, the Hindu Sri Mariamman Temple, the Sultan Mosque, and the Taoist Wak Hai Cheng Temple) may raise hope of an evolving culture of inclusion.
