Elizabeth Loftus offers a good clinical perspective of false memories using the example of Steve Titus being wrongfully convicted. Yet, there was a lot of information omitted involving Titus’s case. She stresses the change in the sexual assault victims testimony from stating that “that ones the closet” when viewing the picture line up, to “absolutely positive on the stand. Yet, he victim did not convict Titus, the jury did and there was much more falsified information presented than her testimony. The admission of doubt in her first witness statement would have been contested by the defense and it would have not been enough information for conviction. Actually there was more (arguably) falsified subsequential evidence shown in court, including the planting of evidence (a brown manila folder) by the Seattle Police. The way that Titus’s civil case is communicated by Loftus is that he was simply unhappy with his conviction, because he was innocent. When in fact he sued on terms of changed and planted evidence in the case, which is reasonably different. The way Loftus portrayed the information of the case/testimony stressed traumatic events distorting memory, the distortion product of the trauma. When in the case of Titus the memory of the victim was distorted intentionally by the police, manipulating her experience in hopes for a conviction without substantial evidence. It seems to me like there’s a big difference. Loftus explains the possibility of planted information but without the relation to the persecutions falsification and Titus’s conviction, using his case as an example seems incomplete.

I think it is very important to realize that memories are not just stored away and replayed when needed. As Loftus explains, they are always changing and being distorted. This is incredibly important to remember when relying on witnesses in any setting. Even though the number of innocent people seems to have dropped as DNA evidence has been taken into account, there are still many people who are convicted of things they did not do due to false memories. It is also important to remember that these memories can be created even when the situation is not stressful. These memories can be created in any setting or changed at any time. I wish there was some sort of test to distinguish false memories from real ones but given the way that they form is basically the same as a real memory, I doubt we will be able to.
